These Terms of Use (“Terms”) govern access to and use of the DriverReady English website, applications, demonstrations, simulations, pilot programs, training materials, and related services (collectively, the “Services”).
The Services are provided by DriverReady English (“DriverReady,” “we,” “us,” or “our”).
By accessing or using the Services, you agree to these Terms.
If you do not agree to these Terms, do not use the Services.
1. DriverReady Services
DriverReady provides educational, training, practice, and readiness tools designed to help commercial drivers practice English communication, roadside interactions, highway-sign recognition, and related skills.
Features may include:
- Roadside-interaction simulations
- Voice practice
- Speech-recognition exercises
- Highway-sign recognition
- Phrasebooks
- Flashcards
- Daily practice
- Readiness assessments
- Driver reports
- Fleet or school dashboards
- State-specific training resources
- Demonstration environments
- Pilot programs
DriverReady may modify, add, remove, suspend, or discontinue features from time to time.
2. Training Platform — Not Government Certification
DriverReady is an independent training and readiness platform.
DriverReady is not affiliated with, sponsored by, approved by, or endorsed by the Federal Motor Carrier Safety Administration (“FMCSA”), the U.S. Department of Transportation (“USDOT”), any state motor vehicle agency, law-enforcement agency, or any other government entity.
DriverReady does not:
- Issue commercial driver's licenses
- Provide government certification
- Conduct official FMCSA examinations
- Conduct official roadside inspections
- Determine legal compliance
- Guarantee that any user will satisfy regulatory requirements
- Guarantee the outcome of any inspection, examination, enforcement interaction, employment decision, or licensing decision
Any DriverReady score, result, readiness designation, or recommendation is a proprietary training metric intended for educational and readiness purposes only.
3. No Guarantee of Inspection Outcomes
Roadside interactions and enforcement decisions may vary depending on the officer, jurisdiction, circumstances, regulations, policies, and facts involved.
DriverReady simulations are intended to provide realistic practice but may not reproduce every question, sign, instruction, procedure, or condition that a driver may encounter.
Successful performance within DriverReady does not guarantee successful performance during an actual roadside interaction or inspection.
4. User Responsibilities
You agree to use DriverReady lawfully and responsibly.
You are responsible for:
- Providing accurate information when requested
- Using the Services for legitimate training, educational, or evaluation purposes
- Reviewing applicable laws, regulations, licensing requirements, and employer policies independently
- Exercising your own judgment in real-world driving and roadside situations
- Following lawful instructions from government officials and law-enforcement personnel
DriverReady should supplement, not replace, professional instruction, employer training, official regulatory guidance, or independent legal or compliance advice.
5. Fleet, Employer, and School Use
DriverReady may be used by fleets, employers, CDL schools, workforce programs, instructors, and other organizations.
Organizations may use the platform to help assess training needs, assign practice, monitor participation, and review DriverReady readiness information.
DriverReady results should not be used as the sole basis for:
- Hiring or termination
- Discipline
- Compensation decisions
- Licensing determinations
- Legal-compliance determinations
- Immigration decisions
- Government benefits decisions
- Other high-impact decisions affecting an individual
Organizations using DriverReady are responsible for ensuring that their use of DriverReady information complies with applicable employment, education, privacy, discrimination, labor, and other laws.
6. Voice and Speech Features
Certain features may use:
- Microphone access
- Browser speech recognition
- Speech-to-text technology
- Text-to-speech technology
- Generated transcripts
Speech-recognition technology is imperfect.
DriverReady does not guarantee that spoken responses will be transcribed accurately.
Factors such as:
- Accent
- Pronunciation
- Background noise
- Device quality
- Browser compatibility
- Internet connection
- Microphone quality
- Speech-recognition technology
may affect results.
Users should review transcripts where possible and may use available typed-answer alternatives when voice functionality does not operate reliably.
7. Demonstration and Sample Data
DriverReady may provide demonstration environments containing sample drivers, example organizations, sample results, or fictional data.
Sample information is provided solely to demonstrate product functionality.
It should not be interpreted as:
- Real customer information
- Verified user performance
- Actual pilot results
- Industry benchmarks
- Government data
- Promised outcomes
8. Pilot Programs
DriverReady may offer free or limited pilot programs to fleets, schools, training providers, or other organizations.
Pilot availability, duration, participant limits, functionality, and terms may vary.
DriverReady may modify or discontinue a pilot program at any time unless otherwise agreed in writing.
Participation in a pilot does not guarantee future pricing, functionality, availability, or continued access.
Any separate written pilot agreement between DriverReady and an organization will control over these Terms to the extent of a direct conflict.
9. Acceptable Use
You may not:
- Use DriverReady for unlawful purposes
- Attempt to gain unauthorized access to the Services or related systems
- Circumvent security controls
- Scrape or extract data using automated means except where expressly permitted
- Interfere with the operation of the Services
- Upload malicious software or code
- Attempt to access another user's or organization's information
- Misrepresent DriverReady results as government certification
- Falsely claim affiliation with DriverReady
- Reverse engineer protected software except where prohibited from restricting such activity by applicable law
- Copy or commercially redistribute DriverReady content without authorization
- Use the Services to harass, discriminate against, or unlawfully disadvantage another person
We may restrict or terminate access for misuse.
10. Intellectual Property
DriverReady and its licensors own or license the software, design, text, graphics, simulations, questions, scoring systems, training materials, trademarks, logos, and other content made available through the Services, except for third-party materials identified as such.
Subject to these Terms, DriverReady grants users a limited, non-exclusive, non-transferable, revocable right to use the Services for their intended purposes.
No ownership rights are transferred to users.
11. Third-Party Materials
DriverReady may reference or link to third-party materials, including government resources, CDL manuals, regulatory information, or external websites.
Third-party materials remain the property of their respective owners.
DriverReady does not control and is not responsible for third-party content, accuracy, availability, security, or privacy practices.
References to government materials do not imply government affiliation or endorsement.
12. Regulatory Information
DriverReady may provide information concerning trucking rules, English-language proficiency requirements, roadside practices, licensing requirements, or other regulatory matters.
Such information is provided for general educational purposes.
Regulations, agency guidance, enforcement practices, and legal interpretations can change.
Users and organizations are responsible for consulting current official sources and, where appropriate, qualified legal or compliance professionals.
DriverReady does not provide legal advice.
13. Privacy
Our collection and use of personal information is described in the DriverReady Privacy Policy.
By using the Services, you acknowledge that you have reviewed the Privacy Policy.
14. Availability and Changes
We aim to provide reliable access to DriverReady but do not guarantee uninterrupted or error-free operation.
The Services may occasionally be unavailable due to:
- Maintenance
- Technical problems
- Internet outages
- Third-party service failures
- Browser limitations
- Updates
- Security issues
- Events outside our reasonable control
We may modify the Services at any time.
15. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
DRIVERREADY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND RELIABILITY.
DRIVERREADY DOES NOT WARRANT THAT:
- THE SERVICES WILL ALWAYS BE AVAILABLE
- THE SERVICES WILL BE ERROR-FREE
- SPEECH RECOGNITION WILL BE ACCURATE
- TRAINING CONTENT WILL ADDRESS EVERY POSSIBLE ROADSIDE SITUATION
- READINESS SCORES WILL PREDICT REAL-WORLD PERFORMANCE
- USING DRIVERREADY WILL PREVENT CITATIONS, VIOLATIONS, OUT-OF-SERVICE ORDERS, ACCIDENTS, EMPLOYMENT CONSEQUENCES, OR OTHER OUTCOMES
Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIVERREADY AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICES.
THIS INCLUDES, WITHOUT LIMITATION, LOSSES ASSOCIATED WITH:
- BUSINESS INTERRUPTION
- LOST REVENUE
- LOST PROFITS
- EMPLOYMENT CONSEQUENCES
- ROADSIDE ENFORCEMENT
- LICENSING OUTCOMES
- REGULATORY ACTIONS
- LOST DATA
- RELIANCE ON TRAINING RESULTS
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIVERREADY'S TOTAL LIABILITY ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF:
(A) THE AMOUNT YOU PAID DRIVERREADY DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
(B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations of liability, so these limitations may not apply in full.
17. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless DriverReady and its affiliates, owners, officers, employees, and contractors from claims, liabilities, damages, losses, and expenses arising from:
- Your misuse of the Services
- Your violation of these Terms
- Your violation of applicable law
- Your infringement of another person's rights
This section does not apply where prohibited by law.
18. Suspension or Termination
We may suspend or terminate access to the Services if we reasonably believe a user:
- Violated these Terms
- Misused the Services
- Created a security risk
- Engaged in unlawful activity
- Interfered with other users
- Attempted unauthorized access
We may also discontinue all or part of the Services.
19. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles.
Any disputes will be handled in the courts located in Cook County, Illinois, unless applicable law requires otherwise.
This section should be reviewed by legal counsel before publication.
20. Changes to These Terms
We may update these Terms as DriverReady evolves.
When changes are made, we may update the Effective Date above and provide additional notice when appropriate.
Continued use of the Services after revised Terms become effective constitutes acceptance where permitted by law.
